ONLINE Terms & Conditions for Mark W. Craig Auctions 

Buyers Premium and Sales Tax: The Buyer's Premium of 10% will be added to each successful bid. Virginia Sales Tax of 5.3% will be charged on all items unless the buyer provides a valid sales tax exemption form. Sales tax exemption must be claimed and form presented before payment is made.

TAX EXEMPT CUSTOMERS: Please email your tax exempt info to markcraigauctions@gmail.com by 5 p.m. on the day before closing.  If we do not receive it in this time frame you will be charged tax.


Merchandise: All Items Are Sold AS IS, WHERE IS, WITHOUT GUARANTEE. We urge you to examine all items carefully and satisfy yourself as to the condition and bid accordingly. We will not be accepting returns or providing refunds. 


Payment:  Credit Card or Debit Card are approved methods of payment.  There will be a 13% buyers premium added to the total purchase price.  Cards will be charged approximately 30 minutes after the auction ends. 


This online only auction will require bidders to enter a valid credit card in order to register to bid. When registering to bid, the credit card will be checked for available credit of $100 but the card will not be charged. At the end of the auction all successful bidders will receive an invoice via email and payment can be made online. If payment arrangements are not made by the end of the pickup period then the credit card used for authorization purposes at the time of registration will be charged. All payments must be made before any items are removed from the property.


Bidding: You must be registered to place a bid on an item. By placing a bid, you agree to all the terms and conditions that apply to this auction. All bids are final. We cannot retract or remove a bid. We respect your privacy and that of the other bidders. We will not release your information to anyone without your permission. This is an online only auction. The bidding will begin to close at a specified time listed individually for each auction and will close at the rate of three lots per minute with a one minute auto extend. This means that if a bid is placed within one minute of the end of the auction the auction for that item will auto extend for an additional minute until no more bids are placed within the last minute. In the event the auto-extend time needs to be reduced, Mark W. Craig Auctions reserves the right to adjust the auto-extend, as needed.


Bidder Registration & Verification:  The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Mark W. Craig Auctions will reject the registration, and bidding activity will be terminated.  Mark W. Craig Auctions has the sole authority to resolve any bidding disputes as they may arise.  For verification purposes, a credit card is required in order to register for this auction.  Upon registering, an authorization charge of $100.00 will be charged against the credit card used for registration (your card will only be “Pinged” and not charged).  This authorization is not a permanent charge placed on your card, it is only a pre-authorization used to verify identity of our bidders and the availability of funds on the credit card used for registration.  Please be advised that Mark W. Craig Auctions has no control over the length of time the verification charge remains on your card; that is at the sole discretion of your credit card company.  Also, please be aware that registering for multiple auctions could incur multiple verification charges; and in some instances, multiple verification charges may result in a fraud alert being sent to the card holder.  Mark W. Craig Auctions reserves the right to reject or accept bidder registrations at its sole discretion. 

Bidding:  The auction software and our online bidding platform will notify bidders by email if they have been outbid.  Please consider using the “Max Bid” feature as this will allow the software to bid on your behalf up to, but not exceeding, your Max Bid.  If two or more bidders put in the same Max Bid, the auction software will recognize the earliest placed bid.

Shipping: Shipping will be listed under each individual auction.  Most auctions will have no shipping.


Preview and Pickup Information:  Preview and pickup times will be listed in each online auction description since this information changes per auction.  You will need to bring a copy of your paid invoice to pickup.  Please pay attention to item descriptions as some items are available for pickup at an off-site hospital property.  Please bring help to assist you in loading your purchases.

Condition: All information contained herein is believed to be correct to the best of the auctioneer’s knowledge. The information is being furnished to bidders for the bidder’s convenience and it is the responsibility of the bidder to determine that information contained herein is accurate and complete.  Any reliance on the contents shall be solely at the recipient’s risk. Bidders must conduct and rely solely upon their own investigations and inspections. The property is being sold ’AS IS’ with any and all faults. Please review all information supplied, and seek appropriate assistance prior to bidding.   Condition details are offered as courtesy to bidders, and are opinions only, not statements of fact, and do not imply any warranty concerning condition, or any assumption of liability. Lot announcements, listings, photographs, and catalog information are for descriptive purposes only.

Craig Auctions is not responsible for injury or damage of any kind, to anything or anyone, while previewing, bidding, loading out, or conducting business. By placing a bid, you agree to hold Mark W. Craig Auctions and its agents harmless regardless of opinion. 


Auctioneer’s Announcement:  The auctioneer reserves the right to accept bids on behalf of internet bidders, absentee bidders, the seller or himself.  The auctioneer reserves the right to accept or reject any bid and in all cases of dispute the auctioneer’s decision shall be final.


Agency Disclosure: In all transactions, the auctioneer is acting as agent for the seller, not as buyer’s agent. Mark W. Craig Auctions reserves the right to remove or cancel the bids and/or bidding rights and privileges of any party, deemed not to be in the best interest of the seller, at any time. At auctions with reserve, the seller and/or auctioneer reserves the right to bid.  In all cases of dispute the auctioneer’s decision shall be final.


Technical Issues: Neither the company providing the software nor the auction company shall be held responsible for a missed bid or the failure of the software to function properly for any reason.  In the unfortunate event of a DDOS attack or server attack/shut down, the auction company reserves the right, but is not required, to change the bid closing deadline.
